JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2020 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Tankuppa P.S. Case No. 100 of 2019 for the offence under Sections 379 and 411/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are not named in the first information report and they are in custody since 23.09.2019.
The allegation against the petitioners is that they were involved in committing theft of the motor-cycle. Considering the fact that the petitioners have got no criminal antecedent and nothing was recovered from their possession, the Court is inclined to grant bail to them. The
Patna High Court CR. MISC. No.3851 of 2020(2) dt.29-01-2020 2/2 petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st, Gaya in connection with Tankuppa P.S. Case No. 100 of 2019.
