Heard the parties.

The petitioner is apprehending her arrest in a case registered for the offence punishable under Section 302 of the Indian Penal Code.

According to F.I.R., the petitioner along with her husband snatched the baby from the lap of the informant and thrashed him on the ground, as a result whereof the baby died. Another eye witness has also supported the allegation before the police.

Learned counsel for the petitioner submits that due to accidental fall the baby died and false allegation is there due to other dispute.

Patna High Court CR. MISC. No.2214 of 2020(3) dt.16-06-2020 2/2 Considering the material aforesaid, in my view, this is not a fit case for anticipatory bail. Hence, prayer for anticipatory bail of the petitioner is refused in connection with Jahanabad P.S. Case No. 654 of 2019, G.R. No. 1678 of 2019. Petitioner is directed to surrender and pray for regular bail.
