The petitioner seeks bail in connection with Excise Case No. 389 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 250.560 liters of English wine has been recovered from the Xylo Car and two persons were caught, who disclosed their name as Rakesh and Bitu Kumar (petitioner). Petitioner is apprehended on the spot. Learned counsel for the petitioner further submits that the petitioner is in jail custody since 13.11.2019.

The petitioner is agreed to deposit Rs.15,000/- (fifteen thousand) in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, the court below shall release the petitioner on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge II cum Special Judge Excise, Gopalganj in connection with Excise Case No.389 of 2019.
