Petitioner is not named in the first information report but in course of investigation, he was summoned by the police under section 41(1) of the Code of Criminal Procedure and after enquiry, Investigating officer found involvement of the petitioner in alleged crime which is evident from para 156 of the case diary but admittedly, other accused confessed their guilt but they did not name the petitioner in the present crime and, therefore, it appears that except suspicion, there is nothing against the petitioner. Moreover, none has seen the actual killing of deceased and some co-accused persons have already been granted privilege of bail by different benches of this court.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
Patna High Court Cr.Misc. No.3219 of 2015 (3) dt.20-04-2015 amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in Pakridayal P.S. Case no. 88/2014.
