The petitioners apprehend their arrest in connection with Khazanchi Hat (Madhubani) P.S. Case No. 888 of 2019 for the offence under Sections 147, 148, 149, 341, 342, 323, 307, 332, 333, 353, 186, 188, 224, 225 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act. Allegation against the petitioners is that they were not assisting the police in the matter of search and seizure of liquor. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and there is no specific allegation against the petitioners. He further submits that in the instant case one bottle containing 750 ml liquor was

Considering the fact that in the instant case 750 ml liquor was seized and there is no allegation that the petitioners were involved in any trade or activities relating to trade of liquor, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Purnea in connection with Khazanchi Hat (Madhubani) P.S. Case No. 888 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
