The petitioner seeks bail in anticipation of his arrest in connection with Ballia P. S. Case No. 241 of 2018 dated 23.08.2018 instituted for the offences under Sections 447, 341, 323, 504, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is alleged to have put the informant and others under the fear of being shot at and also assaulted some of the members of the prosecution side. Allegation of opening fire also has been attributed against the petitioner. Learned counsel for the petitioner has submitted that such allegations do not appear to be trustworthy for the

Patna High Court Cr.Misc. No.5911 of 2019(2) dt.04-02-2019 2/2 reason that nobody appears to have been injured in the occurrence. The reason for falsely implicating the petitioner is not far to seek. The father of the petitioner has earlier filed a petition against the petitioner and others vide Ballia P. S. Case No. 161 of 2018 dated 12.06.2018 under various sections of the I.P.C.

Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Ballia P. S. Case No. 241 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
