In this case, the petitioner is seeking bail in connection with S.T. No. 81 of 2014 arising from Rudrapur P.S. Case No. 03 of 2013 registered for offences under sections 366(A)/34 IPC and later on, Section 376 IPC has been added. From the first information report it appears that on 18th January 2015, Suman Kumar Ram and Tuntun Yadav have forcibly took away the victim girl, kept in a room and later on, Suman Kumar Ram committed rape on the victim which is apparent from the statement recorded under Section 164 Cr.P.C. of the victim girl. Patna High Court Cr.Misc. No.19119 of 2015 (2) dt.16-06-2015 2/2 allegation of committing rape on the victim, has already been granted bail by this Court in Cr. Misc. No. 17510 of 2015. Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Madhubani in S.T. No. 81 of 2014 arising from Rudrapur P.S. Case No. 03 of 2013, subject to the condition that one of the bailors shall be a close relative of the petitioner and the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence and shall appear, in the learned Court below, as may be directed.
