ANSHUMAN ORAL ORDER 06-02-2025 Heard Learned Counsel for the petitioner, Learned Counsel for the State and Learned Senior Counsel for Bihar State Religious Trust Board.

2. Learned Counsel for the petitioner fairly submits that during pendency of the writ petition, petitioner died. As such, he submits that time may be granted so that the new person who has been appointed as Trustee be file substitution petition in this case.

3. Learned Senior Counsel for Bihar State Religious Trust Board submits that Annexure-B is the document which is

In the said document, it has been categorically mentioned that any other person who claim to be the trustee, shall be appointed only after passing order by Bihar State Religious Trust Board. Till date, no one has come forward before this Hon'ble Court.

4. Learned Counsel for the State submits that until and unless the correct person will not come, the compensation amount could not be granted to anyone. The proposal has been made by the State to provide the account of the trust, so that the admitted compensation amount may be transferred in the account of the trust.

5. In this background, this Court hereby disposed off the writ petition due to death of petitioner who was trustee. Liberty is hereby granted that whosoever be legally appointed as trustee shall obtain the account number of the trust and shall sue further so that the admitted amount be transferred to the account of the trust. It is made clear that the said newly appointed person shall have right to pursue for compensation including enhanced compensation, if any.
