The petitioner seeks bail in Manjhi P.S. Case No. 05 of 2014, registered for the offences punishable under Sections 363, 366 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is alleged to have taken the victim to her house, but there is no allegation of kidnapping against the petitioner. The victim had love affairs with the brother of the daughter-in-law of the petitioner. Rajwanti Devi has already been enlarged on anticipatory bail. The victim did not make any specific allegation against the petitioner in her statement under Section 164 of the Cr.P.C.
Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.18383 of 2015 (2) dt.15-06-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Manjhi P.S.
