Petitioner is accused in connection with Jamalpur P.S. Case No. 45 of 2010 registered under Sections 364/34 of the I.P.C.
The allegation of informant Poonam Devi is that her son Ashish Kumar Sinha moved from the house along with his friend Lalu on 01.06.2010 at about 9.00 pm. On 30.05.2010, a Barat party had come in village in scuffle, his son was threatened by Manoj Singh, Sonu Singh and 4-5 unknown. Later on, the dead body of son of the informant, Ashish Kumar Sinha was found near drain.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.18409 of 2015 (3) dt.09-09-2015 2/2 submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. In course of investigation, witnesses Satrudhan Yadav and Santosh Kumar stated that the petitioner and Sonu Singh were seen moving with Ashish Kumar Sinha along with others. Except that, there is nothing against the petitioner. It is also submitted that petitioner is in custody since 09.12.2014. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Munger in connection with Jamalpur P.S. Case No. 45 of 2010. Out of two sureties, one surety must be parents or close relatives of the petitioner.
