The petitioner seeks pre-arrest bail in connection with Harnaut P. S. Case No.331 of 2018 registered under Sections 420 and 406 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the petitioner had not committed any forgery in Provisional National Trade Certificate granted to him by the Department of Labour Employment and Training. As a matter of fact, the mistake was done by the authority, who had issued the certificate in which marks obtained by the petitioner was shown as 587. When the dispute arose, the petitioner made an application for correction in the marks obtained and authorities corrected the same as 577 in lieu of 587. He submitted that the

Patna High Court Cr.Misc. No.4742 of 2019(2) dt.31-01-2019 2/2 petitioner had submitted the said certificate without having any knowledge about any incorrect entry made in the Provisional National Trade Certificate.

Learned Additional Public Prosecutor for the State has opposed the application for grant of pre-arrest bail to the petitioner. He submitted that correction was made in the marksheet, which has been marked as Annexure-3 to the application only after the fraud was detected and the FIR was instituted. Be that as it may, considering the nature of allegation and the defence taken by the petitioner, in the event of arrest or surrender before the court below, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in Harnaut P. S. Case No.331 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) kanchan/- U T
