JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Barauni (Gadhara) P.S. Case No. 381 of 2015 registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

Allegedly, the petitioner called the husband of the informant and took away and thereafter two motorcycle borne criminals shot the husband of the informant and the doctor declared him dead and further the petitioner also tried to flee away with cycle but was caught.

Submission is of false implication and on the part of the petitioner there was no intention to commit murder, simply the

No.10247 of 2016 (3) dt.18-04-2016 petitioner has called the husband of the informant, without any legal and tangible material the petitioner is suffering in custody since 20.10.2015 to which the learned A.P.P. opposes by submitting that under criminal conspiracy, the petitioner called the husband of the informant and took away him near motorcycle borne criminals and got killed the husband of the informant. In the facts and circumstances stated above, at present I am not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected in connection with Barauni (Gadhara) P.S. Case No. 381 of 2015 pending in the court of learned C.J.M., Begusarai.

However, the trial court is directed to expedite the trial and conclude the same within six months failing which the petitioner may be at liberty to renew his prayer for bail. (Jitendra Mohan Sharma, J) sushma/- U T
