Mr.Nityanand ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Sultanganj P.S. Case No. 82 of 2018, G.R. No. 1639/18 for the offences punishable under Section 392 of the Indian Penal Code.

The allegation is regarding unknown miscreants having intercepted the informant while he was coming on auto rickshaw and thereafter one 32 Inch LED TV and other articles including cash were snatched.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case on account of being accused in three other cases. However, it is stated that the petitioner is on bail in those three

Patna High Court Cr.Misc. No.4923 of 2019(2) dt.29-01-2019 2/2 cases. Nonetheless, the petitioner is ready to deposit a cash of Rs. 25,000/- before the court concerned for the purposes of grant of bail. It is submitted that the petitioner is languishing in custody since 03.11.2018.

Having regard to the facts and circumstances of the case, the present bail petition is disposed of with a direction to the petitioner to deposit a sum of Rs. 25,000/- before the Nazarat of the concerned trial court whereupon the petitioner, above named, shall be released on bail subject to such condition as may be imposed by the learned court of Additional Chief Judicial Magistrate, VI, Patna City in connection with Sultanganj P.S. Case No. 82 of 2018.

It is needless to state that the aforesaid deposit of Rs. 25, 000/- by way of cash deposit shall be subject to final outcome of the trial.
