JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the impugned order that petitioner was all along on bail and had attended trial till 19.05.2010 but, subsequently, he made himself absent from the trial proceeding, resulting cancellation of his bail bonds on 19.05.2010. Moreover, petitioner voluntarily surrendered before the court below on 27.01.2016 and since then he is languishing in jail custody. It would also appear that the present occurrence took place in the year 1998 and the case of the petitioner was committed to the court of sessions in the year 1998 and from 1998 till 2010, petitioner attended the trial without fail but in spite of that, his trial could not be concluded and when he made defaulter

Patna High Court Cr.Misc. No.12831 of 2016 (2) dt.30-03-2016 2/2 on 19.05.2010, the learned court below cancelled the bail bonds of the petitioner.

Considering the aforesaid facts and circumstances as well as conduct of the petitioner and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge-II, Gaya in connection with P.S.Civil Line District Gaya Case No. 352 of 1998.
