JUSTICE ARUN KUMAR JHA ORAL ORDER 13-07-2026 The present criminal revision petition is filed for quashing the order dated 04.06.2024 passed by the learned Additional Sessions Judge-II, Vaishali at Hajipur in Cr. Revision No. 69 of 2023 arising out of order dated 12.01.2023 passed by learned JMFC, Vaishali at Hajipur in Complaint Case No. C13327/2022.

Though the matter has been listed under the heading "For Orders (On Office Notes)", I find that this revision petition is not maintainable being a revision petition challenging the order of a revisional court. Reference in this regard, could be made to Section 397(3) of the CrPC/ Section 438(3) of the

Patna High Court CR. REV. No.75 of 2025(5) dt.13-07-2026 2/3 BNSS which bars revisional court to entertain second revision filed by the same person.

03. From perusal of office notes, I also find that office has also pointed out this defect as defect no. 6(8).

04. At this stage, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to have the recourse of law in appropriate proceeding before appropriate forum.

05. Prayer is allowed.

06. Accordingly, the present petition is dismissed as withdrawn with liberty as aforesaid.

07. Office is directed to return the certified copies of the petition while substituting the same with authenticated true copy of the petition.

08. At this stage, learned counsel appearing on behalf of the opposite party no. 2 submits that the petitioner has come before this Court in a matter which relates to bouncing of Cheque and opposite party no. 2 has been made to run from pillar to post as the petitioner has been adopting different ploys to avoid his liability and has not been allowing the trial to proceed before the learned trial court. She submits that learned trial court may be directed to expedite the matter and conclude

09. Learned trial court is directed to expedite the trial considering the fact that the compliant case has been filed in the year 2022 and we are in the year 2026.
