JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner and the informant. Nobody appears on behalf of the State. The petitioner is languishing in jail since 13.01.2015 in connection with Ratanpura P.S. Case No. 51 of 2014 registered under section 302/34 IPC and section 27 of the Arms Act. From perusal of the FIR it appears that the disputes between the parties arose over a piece of land. The informant was exerting possession which was objected by the accused persons whereafter it is alleged that an scuffle took place. The brother of the informant came to rescue whereafter one Pramod Mehta is said to have fired which hit the brother of the informant in chest as a result of which he died. The wife of Pramod Mehta is said to have caught the informant.

Patna High Court Cr.Misc. No.18827 of 2015 (2) dt.07-07-2015 2/2 The contention of the petitioner is that no allegation of causing death of the deceased has been attributed to the petitioner. The co-accused of this case namely Manju Devi has been released on bail vide order dated 26.03.2015 passed in Cr. Misc. No. 11335 of 2015 (Annexure-2). The petitioner has no criminal antecedent. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction learned SDJM, Birpur (Supaul) in Ratanpura P.S. Case No. 51 of 2014 on condition that one of the bailors shall be own/close family member of the petitioner. As soon as the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds.
