Petitioner seeks bail in a case registered for the offences punishable under Sections 399/402 I.P.C. and Sections 25(1-b)a,26,35 of the Arms Act.

One loaded country made pistol and cartridges were recovered from possession of the petitioner and suspicion is that the petitioner and others were preparing to commit dacoity. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. There is no cogent material that the assemblage was for preparation to commit dacoity. Many other preparations are not punishable. Investigation of the case is already complete. Petitioner is in

Patna High Court CR. MISC. No.14272 of 2021(2) dt.07-07-2021 2/2 custody since 09.09.2020.

Considering submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Katoriya Police Station Case No.189 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
