The petitioner is apprehending his arrest in connection with Bagaha P.S.Case no.375 of 2017 registered for offences punishable under Section 409 of the Indian Penal Code. Petitioner is accused under Section 409 of the IPC. At the very outset, the learned APP has submitted that the charge-sheet has been submitted in this case showing that the petitioner is absconder in this case.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered on the basis of materials

With the aforesaid observation, this application is dismissed.
