Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. In the present case, the petitioner seeks bail in connection with Bettiah (Town) P.S. Case No. 75 of 2021 registered for the alleged offence under Sections 406, 420, 467, 468, 471, 120B/34 of the Indian Penal Code and Section 138 of Negotiable Instruments Act.

The allegation against the petitioner is that he and other co-accused persons issued three cheques for an amount of Rs.1,35,901/-only in favour of complainant and the said cheques were dishonoured.

No.4031 of 2022(2) dt.08-06-2022 2/3 It has been submitted by the learned counsel for the petitioner that the petitioner was merely an employee, who resigned from his job in the year 2017 and the cheques were issued in the year 2021. The cheques were signed by the Directors of the Finance Company where the petitioner was an employee. If any offence is made out, it would be against the Director and the person, who were involved directly in the matter and it would not be against the petitioner. The petitioner is in custody since 01.09.2021.

The contention of the petitioner has been vehemently opposed by learned APP.

Having regard to the submission made hereinabove and considering the fact that the petitioner is said to be an employee of the Finance Company and the cheques did not bear his signatures and nothing specific has been mentioned against the petitioner in the complaint filed by the complainant, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran/court concerned in connection with Bettiah (Town) P.S. Case No.75 of 2021, subject to the following conditions :

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence for three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
