Case no. 256/2014 registered under section 302/34 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.

Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Patna High Court Cr.Misc. No.3316 of 2015 (3) dt.20-04-2015 Petitioners are not named in the first information report but in course of investigation, spy of police disclosed name of the petitioner in Cr. Misc. no. 5859/2015 and thereafter, Investigating officer recorded the statement of witness Raju Bhagat who claimed that on the alleged date of occurrence, he had seen the petitioners returning from Bahiyar in suspicious condition and he also noticed blood on the hand of the petitioner in Cr. Misc. no. 5859/2015 and thereafter, petitioner in Cr. Misc. no. 5859/2015 was arrested and made his confessional statement.

Considering the materials available on record as well as submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Makhdumpur P.S.
