JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 This is an application for grant of anticipatory bail in connection with Narpatganj P. S. Case No. 511 of 2017 disclosing offences under Sections 341, 323, 379, 354 504 of the Indian Penal Code.

As per F.I.R. it appears that there was a land dispute between the parties and there is specific allegation against the petitioner no.1 of assault by rod and against the petitioner no.2 and 3 of tearing the saree to the informant.

Submission of the learned counsel for the petitioners is that only due to land dispute, they are implicated in this case and except Section 354 of IPC, all the other sections are bailable and allegation of tearing saree is ornamental in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Sri R . Ranjan learned Judicial Magistrate-II Class, Ararai, in connection with Narpatganj P. S. Case No. 511 of 2017. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
