Petitioner is not named in the first information report and is languishing in jail custody since 14.12.2015 in a case registered under section 392 of the Indian Penal Code.

The impugned order does not show as to how the name of the petitioner came in this case and what material was collected by the I.O against the petitioner except criminal history of the petitioner. Learned counsel for the petitioner submits that the name of the petitioner came in this case in the confessional statement and except confessional statement, there is nothing against the petitioner. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S.
