JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in a case registered for the offence punishable under section 394, 307, 412, 413 of the Indian Penal Code and Section 27 of the Arms Act. The informant's tempo which was being driven by his brother Jitendra Kumar was taken away by unknown miscreants under deceitful means after tying Jitendra Kumar regarding which father of the informant informed. Thereafter the informant proceeded in search of the tempo and found the same during the nips of the day having occupied by four persons who, seeing the informant, escaped there from and during escape,one of

On hue and cry as well as hearing the firing sound, people being nearby chased and apprehended Irshad Alam while three others managed to escape whose identity has also been disclosed by the aforesaid Irshad Alam as Rabindra Yadav, Dhananjay Chaudhary and Sanjay Giri.

Name of the petitioner appeared on the basis of inculpatory extra judicial confession of the co-accused and is in custody since 2.2.2015. Further more, from paragraph 3 of the petition, it is apparent that since after arrest, he is being remanded in other cases also.

Accordingly, petitioner Dhananjay Chaudhary is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Chanpatiya P.S. Case No. 20 of 2015.
