Petitioners seek bail in a case registered under sections 399. 402 of the Indian Penal Code as well as sections 25 (I-b) A, 26, 35 of the Arms Act.
Petitioners are said to have been caught while they had assembled to make preparation for committing dacoity and on search one Bhujali is said to have been recovered from possession of the petitioner no.1 and so far as petitioner no.2 is concerned, nothing was recovered from his conscious possession.
Para 3 of the petition shows that petitioner no.2 has no criminal antecedent whereas petitioner no.1 is said to have been made accused in a case of electricity theft.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.10575 of 2016 (2) dt.04-03-2016 submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sherghaty (Gaya) in Amas P.S.
