Petitioner apprehends arrest in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.

As per the prosecution case, the petitioner and other co-accused persons withdrew Rs. 5,60,000/- illegally from the accounts of 17 different account holders. The petitioner and the co-accused persons were the employees of the alleged company. It is submitted that petitioner has falsely been implicated in this case with malafide intention and ulterior motive to save the skin of real culprits. It is further submitted that the work of the petitioner is only to forward loan which is sanctioned by the Bombay Office. None of the witness has

Patna High Court CR. MISC. No.7909 of 2023(3) dt.23-06-2023 2/2 named the petitioner at any place in the investigation. Hence, no case is made out against the petitioner. Similarly situated coaccused persons have already granted bail by this Court vide order dated 16.02.2023 in Cr. Misc. No. 50243 of 2022. The petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in Amarpur in connection with Amarpur P.S. case no 38 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
