2 The petitioner seeks regular bail in a case registered for the offence punishable under Sections 97 of the BNS and Section 8 of the POCSO Act.

3 The prosecution case, in short, is that the petitioner has touched inappropriately the minor daughter of the informant.

4 Learned counsel for the petitioner submits that during the course of investigation, the petitioner was identified from CCTV footage. From perusal of the statement of the victim, it is clear that she has stated that one person has inappropriately touched her. One relation of the victim was also

Patna High Court CR. MISC. No.4926 of 2026(4) dt.04-05-2026 2/2 with her who has also stated that the petitioner has inappropriately touched the victim and he was identified in the CCTV footage. Learned counsel for the petitioner further submits that the petitioner was merely a purchaser at the shop and only allegation against him is that of inappropriately touching the minor daughter of the informant. The petitioner is in custody since 14.11.2025 having clean antecedent. 5 Learned APP appearing for the State has vehemently opposed the prayer for bail.

6 Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (PCSO Act), Jamui in Jhajha PS Case No 528 of 2025.
