Patna High Court CWJC No.1840 of 2020(3) dt.18-02-2020 2/3 ORAL ORDER 18-02-2020 Heard learned counsel for the parties.
The petitioners are aggrieved by the decision of the respondents vide orders dated 7.5.2010 and 21.7.2008, as contained in Annexures 1 and 2 to both the writ petitions, whereby services of the petitioners have not been approved. Learned counsel for the petitioners placed reliance on the judgment dated 18.05.2006 in WP(S) No. 5412 of 2005 rendered by a learned Single Judge of Jharkhand High Court which was approved by the Division Bench in LPA No. 400 of 2006 vide order dated 24.11.2006 and also by the Apex Court vide order dated 15.5.2007 in SLP (Civil) No. 4396 of 2007, Annexures 5,6 and 7 to the writ petition.
Without going into the merit of the case, the writ petitions are disposed of with the direction to the respondents to take appropriate decision keeping in view the orders as contained in Annexures 5,6 and 7. Necessary decision in this regard must be taken by the respondents at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order.
The orders dated 7.5.2010 and 21.7.2008, as contained in Annexures 1 and 2 of both the writ petitions, shall not come in the way of the respondents in consideration of the
Patna High Court CWJC No.1840 of 2020(3) dt.18-02-2020 3/3 claim of the petitioners.
With the aforesaid, both the writ petitions stand disposed of.
