JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 Petitioners seek regular bail in connection with Shankarpur P.S. Case No. 121 of 2019 corresponding to Excise Act Case No. 913/19(5) registered for the offence(s) punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016. Recovery of 232.2 liters of liquor from the house of the petitioners and the brother of the petitioners was arrested who disclosed the name of the petitioners and other accused persons who were carrying the illegal business of liquor. Submission of the learned counsel for the petitioners is that they have not been arrested at the spot. They are in custody since 17.12.2019 having no criminal antecedent.

Patna High Court CR. MISC. No.7018 of 2020(2) dt.06-02-2020 2/2 Heard learned A.P.P. who has opposed the prayer for bail on the ground that there is a huge recovery of liquor from the house of the petitioners.

Having heard both sides, in view of the submissions, made above, I am not inclined to grant bail to the petitioners at this stage. However, once charge has been framed, the petitioners are at liberty to renew their prayer for bail. (Vinod Kumar Sinha, J) Ankit/- U T
