Petitioner is named in the first information report but omnibus allegation of assault has been levelled against the petitioner and co-accused.

Learned counsel for the petitioner submits that there is case and counter case between the parties and, as a matter of fact, alleged occurrence took place on account of land dispute. From perusal of the case diary, I find that in course of treatment, one Badri Paswan died but it is not specific who had given fatal blow to the deceased- Badri Paswan.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
