The petitioner apprehends his arrest in Complaint Case No.C1 2660 of 2016, Trial No.814 of 2016 registered under Sections 498(A) of the Indian Penal Code. The complainant alleged that she was married with the petitioner in the year 2002 but her husband and other in-laws subjected her to all sorts of torture due to non-fulfillment of demand of dowry.

The learned counsel for the petitioner submits that complainant was living with the petitioner in Bangalore but the complainant fled away with one Ballu Paswan and lodged this

Patna High Court Cr.Misc. No.8416 of 2019(2) dt.13-02-2019 2/2 complaint. The marriage was solemnised in the year 2002. Although complainant alleged that she was subjected to torture due to non-fulfillment of additional demand of dowry immediately after marriage but she filed the complaint only in the year 2016 and this fact itself shows the falsity of the allegation made by the complainant.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Vaishali at Hajipur in connection with Complaint Case No.C.I 2660 of 2016, Trial No.814 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
