JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-04-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Rajgir P.S. Case No.103 of 2013, disclosing offences under Sections 328 and 302/34 of the Indian Penal Code.

The petitioner is father-in-law of the deceased. It is submitted on behalf of the petitioner that the police, upon completion of investigation, submitted final form and did not sent-up the present petitioner for

Patna High Court Cr.Misc. No.14090 of 2016 (2) dt.20-04-2016 2/2 trial. However, learned court below has summoned the petitioner also, therefore, he has reasonable apprehension of arrest. He further submits that the husband of the deceased has been granted regular bail by this Court. From the First Information Report, it appears that there is no specific allegation against this petitioner of any nature, leading to the death of the deceased. Considering the facts and circumstances, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, in connection with Rajgir P.S. Case No.103 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
