The petitioner seeks bail in connection with K. Hat (Maranga) P.S. Case No. 594 of 2021 registered for the offences punishable under Sections 399 and 402 of the I.PC. read with Sections 25(1-b)A, 26 and 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 25.07.2021, charge-sheet has been submitted in the case and is a person with clean antecedent and the allegation is of recovery of arms and cartridges from apprehended accused.

The learned counsel submits that petitioner was not arrested from the spot as such, nothing was recovered from his

Patna High Court CR. MISC. No.3939 of 2022(2) dt.26-05-2022 2/2 possession and his name came in the confessional statement of the accused who were apprehended at the place of occurrence. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, is a person with clean antecedent and was not arrested from the spot and nothing was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with K. Hat (Maranga) P.S. Case No. 594 of 2021.
