JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-376(I) of the Indian Penal Code.

Taking into consideration that petitioner surrendered before the court below after 12 years of the occurrence and there is specific allegation of rape against him, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Thakaraha (Bhitaha) P.S. Case No. 41 of 2003 corresponding to Sessions Trial No. 708 of 2014 pending in the court of learned Additional District & Sessions Judge-II, Bagaha, West Champaran, Bettiah stands rejected.

However learned trial court is directed to expedite the

Patna High Court Cr.Misc. No.10218 of 2016 (2) dt.11-05-2016 2/2 trial of the petitioner and try to conclude the same as early as possible.
