The petitioner is an accused in connection with Mofassil P.S.Case No. 541 of 2014 registered under Section 365 of the Indian Penal Code.

The petitioner is not named in the FIR. The victim in his statement under Section 164 Cr.P.C. disclosed about knowing the name of petitioner and others in course of conversation of accused. Submission is that the petitioner has no criminal antecedent and similarly situated co-accused, Mukesh Kuamr, has been granted bail by a bench of this Court vide Cr. Misc. No. 35591 of 2015 and petitioner is in jail custody since 05.01.2016. Having considered the facts and circumstances of
