JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report nor he was charge sheeted when police submitted first charge sheet and it appears that when police submitted second supplementary charge sheet, the name of petitioner was surfaced and he was charge sheeted thereafter. The supplementary case diary reveals that petitioner was arrested by Madhepura police and thereafter, he was interrogated in the present case and after that he confessed his guilt which is evident from perusal of para 131 of the supplementary case diary and except the aforesaid confessional statement, there appears to be nothing against him. No doubt, petitioner carries criminal antecedent of

No.3359 of 2015 (3) dt.20-04-2015 several cases but in almost all the cases, he has already been acquitted and in the present case, except suspicion and confessional statement, there appears to be nothing against him. Moreover, several co-accused persons have already been granted privilege of bail by different Benches of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 50 of 2007, subject to condition that he shall attend the trial court on each and every date in person for the period of one year or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
