JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2017 This restoration petition has been filed for restoration of CWJC No.21196 of 2013 which stood rejected on 13.01.2017 due to non compliance of peremptory order dated 16.12.2016. Submission on behalf of the petitioner is that vide order dated 16.12.2016, petitioner was directed to file requisites for issuance of notices to newly added respondents within the stipulated period of four weeks but unfortunately, the necessary requisites for issuance of notices were filed after three days of stipulated period as a result whereof CWJC No. 21196 of 2013 stood rejected due to non- compliance of peremptory order.
Patna High Court MJC No.515 of 2017 (3) dt.10-08-2017 2/2 In view of the aforesaid submission as well as explanation given in this petition, this restoration petition is allowed and accordingly, CWJC No. 21196 of 2013 is restored to its original file and number.
The office should proceed with CWJC No. 21196 of 2013 as per previous order.
