Rajesh Soni was apprehended while carrying with 48 bottles of 180 ml, 24 bottles of 375ml of foreign wine, Indian origin, who, during course of interrogation had disclosed the petitioner to be owner of the same.

Considering the nature of the allegation as well as criminal antecedent being an accused of excise act bearing Siwan Town P.S. Case No.629/2016 it looks desirable to impose stringent condition in order to forbid the petitioner from having his indulgence in the similar kind of activity when is being enlarged on bail, petitioner Amarnath @ Amarnath Sah is directed to be released on bail on deposit of rupees fifty thousand as cash surety subject to condition that in case of his involvement in excise case in future the aforesaid amount will be forfeited otherwise the amount will be returned

Patna High Court Cr.Misc. No.55369 of 2016 (2) dt.09-01-2017 back to the petitioner after conclusion of the trial relating to Mairwa P.S. Case No.122/2016 to the satisfaction of ACJM, VII, Siwan.
