The petitioner seeks bail in connection with Tankuppa P.S. Case No. 81 of 2023 instituted for the offence under Sections 420, 467, 468, 471 & 34 of the Indian Penal Code.

As per prosecution case, the accused persons came for withdrawal of Rs. 20,000/- but upon suspicion, they were apprehended and later, it was found that fraud withdrawal of Rs. 10,000/- was earlier done by them on 24.04.2023. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.10.2025. Petitioner

Patna High Court CR. MISC. No.7141 of 2026(2) dt.04-02-2026 2/3 bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. During investigation, it is revealed that earlier Rs. 10,000/- was allegedly withdrawn by the petitioner. In this regard, it is submitted that petitioner has no connection with the alleged withdrawal of money. Nothing has been recovered from the conscious possession of the petitioner. Other co-accused has been granted bail by this Court vide order dated 05.07.2024, passed in Cr. Misc. No. 42688 of 2024.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Tankuppa P.S. Case No. 81 of 2023, subject to the following conditions:

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
