The present writ application has been filed by the petitioner for following reliefs:- (i) For issuance of the writ of mandamus directing Respondent no. 5 the Circle Officer, Sadar, Gaya to take appropriate action for demarcation of land appertaining to Khata no. 92 (old) 1125(Kha) (New), Plot no. 453 (old) 3463(New), Municipality Survey plot no. 21296, Area 22 Decimals at Ashok Vihar Colony, Gaya, for which Application and Fee submitted online under Rule 23(2) and 23(3) of the Bihar Tenancy (Amended) Rules 2018, and ensure its peaceful

For direction to comply the Order dated 26.10.2023 (Annexure P/3) passed in Bihar Land Dispute Redressal Case no. 137/2022-23 (Shweta Sinha vs. Ramji Prasad) by the Deputy Collector Land Reforms, Sadar, Gaya (Respondent no.4) whereby and wherein order has been passed as below:

"The Circle Officer is directed to ensure the possession of the land as mentioned in the above registered deed executed in favour of the Plaintiff by demarcating it from the land of the seller and the Trespassers are prevented from causing any kind of disturbance on the suit property."

(iii). For direction to respondent no.5 to stop all mutation of seller's land in vicinity of petitioner's land till final demarcation of the petitioner's land in fact and circumstances of the present case.

(iv). For a mandamus commanding the respondent no. 3 and 6 to take appropriate steps to restrain / prohibit the miscreants from construction and causing nuisance on the petitioner's land and to maintain law and order during demarcation of the land of the petitioner.

(v). For grant of other relief/ reliefs to which the petitioner is found entitled to in facts and circumstances of the present case.

3. Learned counsel for the petitioner submits that his application for demarcation of the land in question is still pending before the Circle Officer, Sadar, Gaya.

4. The Circle Officer, Sadar, Gaya is directed to dispose of the application of the petitioner, in accordance with law.

5. With these observation/direction, the writ petition stands disposed of.
