The petitioner, being the sister's son of the husband of the victim, is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 302 and 201/34 of the Indian Penal Code.

The prosecution case as per the written report of Sheikh Kamruddin submitted to the Station House Officer of Pachpakari O.P. is to the effect that the informant's daughter, Ajim Khatoon was married with Sheikh Nurul @ Nanhai about 10 years prior to the lodging of the case. The daughter of the informant went traceless, hence, the present case has been lodged.

It is submitted by learned counsel for the petitioner that subsequently, the victim came back and in her statement

Patna High Court CR. MISC. No.4815 of 2020(2) dt.29-02-2020 2/2 recorded under Section 164 Cr.P.C. which has been recorded by learned ACJM, Sikrahana, wherein thrust of accusation has been made against the husband of the daughter of the informant. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner is named in the FIR.

Considering the thrust of accusation against the husband of the daughter of the informant and the daughter of the informant, who was suspected to be dead, has already been traced, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahna at Dhaka, District- East Champaran. in connection with Dhaka (Pachpakri) P.S. Case No. 136 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
