Petitioner seeks bail in a case registered under sections 399, 402, 414 of the Indian Penal Code as well as sections 25 (I-b)a, 26,35 of the Arms Act.

One country made loaded katta and two live cartridges are said to have been recovered from conscious possession of the petitioner when he was caught along with other accused to make preparation for committing bank dacoity.

Moreover, petitioner is in jail custody since 11.12.2015 and he does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the 7th Addl. Chief Judicial Magistrate, Saran at Chapra in Derni P.S. Case no. 120/2015. shahid (Hemant Kumar Srivastava,J) U T
