JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner in the present case is seeking regular bail in connection with Chanpatia (Sirisiya) P.S. Case No. 344 of 2019 registered under Sections 467, 468, 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in any theft case and has no concern with the motorcycle. The co-accused Kamal Sah is said to have fled away leaving the motorcycle on the Chowk and further learned counsel submits that the investigation revealing that the petitioner had purchased the motorcycle is not substantiated from the materials, the petitioner is in

Patna High Court CR. MISC. No.2192 of 2020(2) dt.16-01-2020 2/3 custody since 24.10.2019 having no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that the petitioner is not named in any theft case and he has no concern with the motorcycle and that the coaccused Kamal Sah is said to have fled away leaving the motorcycle on the Chowk and further that the investigation revealing that the petitioner had purchased the motorcycle is not substantiated from the materials, at this stage the petitioner being in custody since 24.10.2019 having no criminal antecedent, let the above-named petitioner be released on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Bettiah (West Champaran), in connection with Chanpatia (Sirisiya) P.S. Case No. 344 of 2019, subject to the condition as laid down under Section 437(3) Cr.P.C. as under:

(a) that such person shall attend in accordance
