JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-01-2022 Heard Mr. Sanjeev Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Piri Bazar P.S. Case No. 31 of 2020 dated 19.03.2020 instituted for the offences under Sections 147, 148, 149, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation against the petitioner and about 40 others is of having made attempts at reaping the standing crops in a field claimed to be of the informant. Learned counsel for the petitioner has pointed out that there is a dispute regarding the ownership of the land which has come in existence because of the alluvial accretion of the river flowing in the area. Patna High Court CR. MISC. No.13704 of 2021(2) dt.03-01-2022 2/2 claimant to the property, of whom the petitioner is only a Bataidar. Because of the petitioner being associated with Fulo Devi, the author of the counter version of this case, he has been made accused in this case.

For the reason of a dispute between the two claimants over a plot of land and the reason for falsely implicating the petitioner in the present case with general and omnibus allegation, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S. Case No. 31 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
