Petitioner seeks bail in Dandari P.S.Case No.81 of 2014 registered under Section 307 and other sections of the IPC. The informant alleged that the petitioner took in his lap his minor son and thereafter the boy was traceless. During the course of investigation, it has come that many persons had seen the petitioner taking the boy. The victim boy was recovered from an orchard in injured condition. The victim was minor and he made his statement and disclosed that the petitioner took him and pressed his eyes. The doctor opined that there was no loss of eye sight.
It is submitted that no case is made out under section 304 IPC as there is no allegation of kidnapping for ransom or kill the boy. The petitioner was also apprehended from his house immediately after recovery of the boy.
Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond
Patna High Court Cr.Misc. No.6633 of 2015 (3) dt.20-04-2015 of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prakash, Judicial Magistrate, Ist Class, Begusari in connection with Dandari P.S.Case No. 81 of 2014.
