Submission is that learned counsel for the petitioner was ill, hence, he could not appear.

Considering the aforesaid facts, let the dismissal of Cr.W.J.C. No. 1103 of 2016 by order dated 08.02.2017 is set aside, however, subject to payment of cost of Rs.500/- (rupees five hundred) in the High Court Victim Compensation Fund by the petitioner.
