Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 341, 323, 324 and 307 of the Indian Penal Code and subsequently Section 302 IPC was added, registered in connection with Jadopur P.S.Case No.170 of 2020.

The learned counsel for the petitioners has submitted that the cause of death, as per the post mortem report, was not the assault, rather it was chronic liver disease. The postmortem report shows that the cause of death is chronic liver disease. He has further submitted that considering these facts, co-accused Ranjeet Yadav and Rikesh Yadav @ Nikesh Yadav

Patna High Court CR. MISC. No.14231 of 2021(3) dt.24-02-2022 2/2 have been granted anticipatory bail by this Court in Cr.Misc. No. 32511 of 2021 under order dated 01.02.2022. The learned APP has opposed the prayer for anticipatory bail and submitted that the witnesses have supported the occurrence in the case diary.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Devendra Prasad, learned Judicial Magistrate, First Class, Gopalganj in connection with Jadopur P.S.Case No. 170 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
