2. The petitioners apprehend their arrest in a case registered for the offence under Sections 120B, 420, 406, 467, 468, 504 and 506 of the Indian Penal Code.
3. It is alleged that these petitioners, who are covillagers of the informant had purchased the land of informant

No.5997 of 2025(2) dt.27-02-2025 2/3 appertaining to Khata No.5, Plot No. 2118, 2119/1, 2119/2, measuring an area of 61.66 Decimals and thereafter, sold the same land on the same date. It is further alleged that informant came in possession of aforesaid land after the decision passed by Munsif-I, Buxar in Title Suit No. 116 of 1970 on 06.05.1975, but these petitioners, in order to grab the land of informant, purchased the land.

Learned counsel for the petitioners submits that petitioner nos. 1 & 2 purchased the disputed land from petitioner nos. 3 to 7 through registered sale-deed dated 16.01.2024 and since then, they are in peaceful possession of land in question and accordingly, petitioners have also paid Malgujari to the State Govt. and Jamabandi of the land in question was also recorded in their names. He further submits that informant's claim over the disputed land is on the basis of compromise decree in Title Suit No. 116/1970, in which compromise decree was passed on 05.12.1975, but informant and others did not take pain to get the land mutated in their favour and never claimed possession of disputed land in the life time of their ancestor Baliram Singh, against whose favour decree was passed in aforesaid title suit. Moreover, the dispute involved in the present petition is purely of civil nature and
Patna High Court CR. MISC. No.5997 of 2025(2) dt.27-02-2025 3/3 none of the acts allegedly committed by the petitioners give rise to any criminal liability. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon P.S. Case No. 199 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
