JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State.
The petitioner apprehends his arrest in Paharpur P.S. case no. 57 of 2014 instituted for the offence under Sections 341, 323, 324, 326, 307, 147, 148, 149, 427, 429 of Indian Penal Code.
It is submitted on behalf of petitioner that after investigation, police has not sent up this petitioner and filed charge-sheet only against accused Basan Mahto which is apparent from the order of the learned Sessions Judge but cognizance has been taken against this petitioner also along with other co-accused by the Court below. As per allegation, this petitioner has assaulted
Patna High Court Cr.Misc. No.11731 of 2017 (2) dt.22-03-2017 2/2 the husband of the informant with barchi causing injury on his right finger. In the injury report which is annexed as Annexure-3 to the petition, doctor has found simple injury on the person of the injured caused by hard and blunt substance.
Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Paharpur P.S. case no. 57 of 2014, he will be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari at East Champaran subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
