JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he took away the deceased but, later on, the other F.I.R named accused kidnapped the deceased and committed his murder. The first information report reflects that when the informant went in search of deceased and enquired from the petitioner, petitioner disclosed the name of those persons who had taken away the deceased. Moreover, when the co-accused Sadanand Yadav was arrested, he confessed his guilt and disclosed the name of his associates including the petitioner. So far as petitioner is concerned, he has only participated in the conspiracy of murder of the deceased.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.10885 of 2016 (2) dt.09-03-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Mungheyr in connection Kotwali P.S.Case No. 248 of 2015.
