The petitioner is in custody in connection with Atri P.S. Case No. 338 of 2018, registered for the offence punishable under Sections 272 and 273 of the Indian Penal code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the name of the petitioner disclosed by one Abhishek Kumar, who was apprehended at spot. Learned counsel for the petitioner further submits that petitioner is in custody in this case on 05.12.2018. He further submits that in the instant case total 140.940 liter English Wine was recovered from the alleged Bolero Vehicle. Learned counsel for the petitioner further submits that petitioner is not at all connected with trade of
Patna High Court Cr.Misc. No.3000 of 2019(2) dt.23-01-2019 2/2 liquor. He further submits that similarly circumstanced other coaccused have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 68546 of 2018 and Cr. Misc. No. 69218 of 2018 vide order dated 30.11.2018 and 04.12.2018 respectively.
Considering the totality of the facts and circumstances as discussed herein above, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge Excise, Act, Gaya in connection with Atri P.S. Case No. 338 of 2018, subject to the conditions that one of the bailor should be elected representative of the local body.
